Front and center on the cover of the Times Union, Joan Porco is pleading for the Bethlehem police and the Albany County DA's office to leave her son alone. In that letter, Joan Porco said:

"I want to say unequivocally that although I have no memory whatsoever of the attack, either because I was asleep or because of my injuries, I am absolutely positive that my son was in no way involved in this heinous crime."

But for the first time since the attack, the District Attorney's office confirms 21-year-old Christopher Porco is a suspect and that based on their evidence, Joan Porco is wrong in claiming her son's innocence.

Albany County District Attorney David Soares said, "I believe we have enough information and evidence to say yes, Mrs. Porco is wrong. And we intend on putting our best case forward to prove that beyond a reasonable doubt."

Law clerk Peter Porco was found beaten to death and his wife attacked in their Delmar home last November. Since then, police have been talking to the couple's son Christopher. And since the beginning, his lawyer, Terry Kindlon, has insisted Christopher is innocent.

"I think Joan Porco's letter destroys and completely obliterates the last tatters of the police claims that Christopher had anything to do with this. The fact of the matter there has never been any factual basis upon which they could accuse Christopher."

There is no statute of limitations on murder. However, the District Attorney said he's confident there will be an indictment in the very near future.
