ALBANY, N.Y. -- An off duty Coxsackie police officer is on the other side of the law after being arrested in Albany.

Police say Kenneth Rosimini pointed a loaded handgun at a man on North Pearl Street early Sunday morning. He was off duty at the time.

Rosimini has been charged with criminal possession of a weapon and menacing after police say he pointed the gun at an acquaintance.

Albany Police Department Spokesperson Steve Smith says the handgun was not the officer's department issued weapon.

"Police officers are police officers 24 hours a day and they do carry guns off duty, most officers carry handguns off duty, not only for their own protection, but because they are police officers every day. We have an obligation to the community and unfortunately, this circumstance was unreasonable and he was arrested," Smith said.

Coxsackie Mayor Mark Evans says Rosimini is a part time officer and has been out with an injury since March. He says he will consult with the town council to determine what action, if any, needs to be taken.
