Battle over 46th Senate could head to court

UPSTATE NEW YORK -- The battle for the 46th Senate District will soon head to court to determine a winner in the race.

Ballot counting in Ulster County ended Tuesday, which is the last of the five counties in the district to get counted. Republican George Amedore now leads Democrat Cecilia Tkacyzk by just 110 votes.

Republicans are challenging 664 ballots, while Democrats have challenged 202. Both sides will appear before in court Wednesday, where a judge must decide whether or not to count the challenged ballots.

Amedore and Tkacyzk both declared victory on Election Day, but the race has been too close to declare an official winner.
