Family of Lembhard asks for special prosecutor

NEWBURGH, N.Y. -- Despite being turned down once by Governor Cuomo, family members of Michael Lembhard are still pleading their case for a special prosecutor.

The family asked city council members to sign a letter during Monday night's meeting which asks for someone outside the community to look into Lembhard's death. They are also asking that Orange County District Attorney Frank Phillips to step down from the investigation.

Lembhard was shot and killed by Newburgh police last month and his family said the use of force was not justified.

The Mayor of Newburgh and council members said they understand where the family is coming from.

"What I want is justice. I want justice, I want fairness. And more than anything, I want to start looking at the bigger picture, and start resolving the violence in the city in general," said Newburgh Mayor Judy Kennedy.

"If they let the door of justice slam on Michael Lembhard, they're opening the door to have it happen to their son, their brother, their cousin, their nephew. It's gonna hit home," said Juanita King, Michael's cousin.

Kennedy said there are many cases of violence in the city and she is working on new ways to bring peace to Newburgh.
