NEWBURGH, N.Y. -- After more than two weeks, there is still no word from the Governor's office on whether or not Cuomo will appoint a special prosecutor to investigate the police involved shooting case of Michael Lembhard.

Mayor Judy Kennedy says she expects an answer by the end of the week, but the family says the longer they wait, the more tainted the crime scene becomes.

The Lembhards say police bungled their investigation, leaving bullet shells in the apartment. Monday's city council meeting was disrupted a few times by chants of "no justice, no peace," resulting in the arrest of one community activist for disorderly conduct.

"We're out here because we aren't getting any answers from the mayor to the chief of police to Governor Cuomo, nobody is giving us answers. We need answers. We're going to stay here every day until we get justice," said Edith King, an aunt of Michael Lembhard.

“I'm very concerned about this and I'm basically working on this night and day to make sure that we come to some kind of fair and equitable resolution to this," said Newburgh Mayor Judy Kennedy.

Lembhard’s family is rallying daily near city hall and planning a large march for Saturday at 3 p.m.
