DA: Police justified in using deadly force against Nah-Cream Moore

Albany police officers will not be charged the death of Nahcream Moore, 19. Albany County District Attorney David Soares made the announcement thursday afternoon. Our Erin Connolly has the details.

ALBANY, N.Y. -- Albany County District Attorney David Soares says police involved in the fatal shooting of Nah-Cream Moore were justified in using deadly force and will not be charged by a grand jury.

The 19-year-old was fatally shot by police on South Pearl Street on Dec. 29.

Police said Moore was a passenger in an SUV and was wanted for questioning in connection with a home invasion in Albany. Police said Moore got out of the vehicle and reached for a loaded gun during a struggle with police. One of the officers then opened fire, and Moore was pronounced dead at Albany Medical Center.

Dash cam video the night of the shooting was also released. It shows officers approaching Moore's car, Moore getting out of the car, and then a struggle takes place off camera. The shooting happened to the right of the screen.

Soares said, "Upon exiting the vehicle, Moore had a weapon in his hand. Officers observed that weapon and tried to wrestle it out of his hand. They were not successful. As a result, three shots were fired."

Statement from Police Chief Steven Krokoff:

“The Grand Jury that convened to independently investigate the shooting of Nah-cream Moore has determined that the actions taken by Albany Police were justified. We support the findings of this independent investigation.

The results of our internal investigation confirm these findings and indicates that the heroic actions of Officer Mulligan likely saved the life of his partner, Officer Kelly.

These events highlight the challenges our officers face every day. It is my hope that this tragic incident will spur more citizens to join the responsible members of our community who are working with us to rid our city of senseless violence”.
